These Terms & Conditions (the “Terms”) govern access to and use of the Brindi platform, which lets restaurants sell gift cards online and lets people buy and redeem them. By using Brindi you accept these Terms.

Brindi is a platform operated by [Legal name, RUT and domicile] (“Brindi”, “we”) that provides tools for restaurants (“Restaurants”) to issue and sell digital gift cards, and for buyers (“Buyers”) to purchase, gift and redeem them.

Brindi acts as a technology operator and payments facilitator. A gift card is a promise of consumption from the issuing Restaurant: the goods or services redeemed are delivered by the Restaurant, not by Brindi. Unless stated otherwise, Brindi is not a party to the consumer relationship between the Buyer and the Restaurant.

To manage a Restaurant on the platform you must create an account and keep your credentials confidential. You are responsible for all activity under your account.

Buying a gift card as a Buyer may be done without creating an account. You must provide truthful, complete and up-to-date information, and you are responsible for the accuracy of the contact details you provide (for example, the recipient's email).

Payments are processed through MercadoPago (Checkout Pro). By paying you also accept the payment processor's terms and policies. Brindi does not store your full payment-method details.

Prices are shown in Chilean pesos (CLP) and include applicable taxes unless stated otherwise. The gift card is issued and delivered once payment is confirmed by the processor.

In the future, Restaurants will be able to connect their own MercadoPago account, so that the funds from each sale settle directly to the Restaurant's account, net of Brindi's platform fee. In that scenario, the Restaurant is directly responsible to the Buyer for the redeemed service.

Each gift card has a balance, a currency and, where applicable, an expiry date set by the issuing Restaurant in accordance with applicable Chilean law. A gift card is redeemed by presenting its code or QR code at the issuing Restaurant.

The balance is deducted at the time of redemption. Gift cards are bearer instruments tied to the code and should be treated with the same care as cash: Brindi is not responsible for their loss, theft or use by third parties who gain access to the code.

  • Redemption can only take place at the Restaurant that issued the gift card.
  • A gift card that is expired, blocked, voided or already fully redeemed cannot be used.
  • Unless required by law, gift cards are not redeemable for cash.
  • Validity and other specific conditions are set by each Restaurant and shown on the gift card.

Return or refund requests are governed by the consumer-protection rules applicable in Chile (Law 19.496) and by the issuing Restaurant's policies. Given the nature of the product (immediately redeemable), specific conditions may apply.

Where a refund applies, it will be made to the original payment method through MercadoPago, within the processor's timeframes. The issuing Restaurant is responsible for the service committed on the gift card; Brindi assists with the operational handling of the refund where appropriate.

When using Brindi you agree not to:

  • Use the platform for fraudulent, unlawful or unauthorized purposes.
  • Attempt to breach the security, integrity or availability of the service.
  • Resell, duplicate or tamper with gift cards or their codes without authorization.
  • Infringe the rights of third parties or applicable law.

The software, the “Brindi” brand and the platform's content are owned by Brindi or its licensors. Each Restaurant's trademarks, logos and content belong to their respective owners, who authorize their use within the platform to operate their gift-card storefront.

Brindi provides the platform “as is” and “as available”. To the maximum extent permitted by law, Brindi shall not be liable for indirect or incidental damages or lost profits arising from the use of, or inability to use, the service.

Nothing in these Terms limits the non-waivable rights that Chilean law grants to consumers, nor any liability that cannot be excluded by law.

We may update these Terms to reflect changes in the service or in applicable law. We will publish the current version on this page, indicating the last-updated date. Continued use of Brindi after a change constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the ordinary courts of justice with competence in Chile, without prejudice to the rights granted to the Buyer by consumer-protection law.
